1. General

Welcome to LAVIE (“we”, “our”, “us”). These Terms and Conditions (“Terms”) govern your use of our website lavie.co.nz and the purchase of products from our online store. By accessing or using our Site, you agree to be bound by these Terms.

2. Eligibility

To make a purchase through our Site, you must be at least 18 years old and possess a valid credit or debit card issued by a bank acceptable to us.

3. Orders

3.1 Acceptance of Orders

All orders placed by you through our Site are subject to acceptance by us. We reserve the right to reject any order for any reason.

3.2 Pricing and Availability

All prices are listed in New Zealand Dollars (NZD) and include GST. We strive to ensure that all details, descriptions, and prices of products are accurate, but errors may occur. If we discover an error in the price or availability of a product you have ordered, we will inform you as soon as possible and give you the option to reconfirm your order at the correct price or cancel it.

3.3 Pre- Order

Pre orders, it will take about 8 weeks to arrive after payment cleared. We’ll email you when it’s ready for despatch.

3.4 Arrive Soon Order

Products, in Arrive Soon category, will be in NZ stock in 2 weeks.

4. Payment

We accept payment via Stripe (Visa, MasterCard). Payment must be made in full before dispatch of your order. You warrant that the payment information provided by you is valid and correct.

5. Delivery and collection

5.1 Delivery Times

We aim to deliver your order within the estimated delivery times provided at product page. However, delivery times are estimates only and we are not responsible for any delays beyond control.

5.2 Delivery Charges

Delivery charges will be calculated and displayed at checkout. These charges are non-refundable, except in the event of a faulty product.

5.2 Collection in Christchurch if applicable

No change of mind will be accepted when collection has been made in person, as customer had seen and inspected the products.

6. Consumer Guarantees Act

6.1 If the Customer purchases or indicates that the purchase of the goods is for the purposes of a business the provisions of the Consumer Guarantees Act 1993 will not apply.

6.2 LAVIE’s liability is limited to the original purchaser, to the maximum extent permitted by law, not cover for any loss of profits, loss of goodwill, opportunity or any consequential loss or damage.

6.3 The Customer’s sole remedy against LAVIE shall, at LAVIE’s election, be limited to the repair or replacement of the goods or the provision of a refund.

7. Privacy

The information will be collected, held and used on the condition that: It will be held securely, and it will be accessible to our employees and agents who need access to it for the efficient running of the business, and the Customer may request access to and correction of the information at any time.

9. Cancellations

No order, once accepted and despatched, may be cancelled or varied by the Customer. Any cancelled order, where the stock is accepted back, will go through return process, customer will be responsible to return the goods back to LAVIE and cover related shipping cost.
